DEERWOOD LOT 9 SUPPORT REQUESTED

It’s October, beautiful foliage, and things are quiet on the lake. Yet, things are getting ready to heat up in court.
 
As many of you know, it was with great dismay that the public learned of the APA’s apparent readiness in June 2021 to abandon protective permit conditions previously recommended to protect a rare wetland and stream system in Deerwood, Lot 9 - on the shores of Upper Saranac Lake.
 
We are seeking a ruling – against the APA’s arbitrary and capricious unprecedented decision which was to approve an amendment to an existing permit. This amendment allows for an on-site septic system on Lot 9, only 100 ft. from the wetlands boundary and a stream which runs into our lake. We have a strong case and look forward to a win in court!
 
A small group of petitioners have initiated action to protect Upper Saranac Lake water and recreational value, which we will all benefit from. Personally, they have spent over $100,000 in legal fees, 3rd party studies, and consultants.
 
The temporary restraining order to stop further land disturbance and tree-cutting in and around the wetlands would have never occurred without tenacity, generously donated funds, time, along with the swell of support from individuals like you. However, this is not over. Our lawyer, Claudia Braymer, anticipates total expenses for the Article 78 action against the APA (and proactively, against issues related to Santa Clara permitting process) will be at least an additional $25,000.
 
We would like to take this opportunity to again ask you for your support, this time in terms of legal funding to move forward. Many of you around the lake have offered to fund some of these costs. Up until now, we have not asked for financial assistance. However, we are in this for the long run, and we will not stop protecting Upper Saranac Lake water quality until we are certain that the APA will rescind their decision on the dangerous amendment.
 
So, now, we are requesting your financial support for the ongoing legal expenses that up until now, only a few have shouldered. Your contribution will really help.

This important issue personally impacts all of us, our properties, the lake, and the environment.
